Welcome to iUgo.

These Terms and Conditions ("Terms") outline the rules, regulations, and policies for using the iUgo website (located at www.iugo.co) and for booking vacation rental accommodations managed by us across Washington, Virginia, New Hampshire, Connecticut, and Rhode Island. iUgo is a trade name operated by EG Enterprises LLC dba iUgo.

By accessing this website and/or completing a reservation, you (the "Guest," "Client," or "You") agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our website or book a stay with us.

1. Reservations and Dynamic Pricing

1.1 Booking Management: All reservations are managed through our property management system, Hostaway. By booking, you agree that your reservation details will be processed through this platform.

1.2 Dynamic Pricing: Please note that our nightly rates are dynamic and subject to change based on market demand, seasonality, and availability. Prices may fluctuate throughout the day. The rate provided at the time of your confirmed booking is locked in; however, we do not price-match previous or future rates if prices change after your booking is secured.

1.3 Age Requirement: You must be at least 18 years of age to book an accommodation with iUgo. The primary guest who made the reservation must be present for the duration of the stay. A valid government-issued ID matching the name on the credit card used for booking is required prior to or at check-in.

1.4 Right of Refusal: We reserve the right to refuse service to anyone, at any time, for any reason not prohibited by state or federal law.

2. Payments, Fees, and Multi-State Taxes

2.1 Payment Processing: All credit card payments are securely processed through Stripe. iUgo does not store your full credit card details on our local servers.

2.2 Taxes and Local Fees: Because iUgo operates across multiple jurisdictions, all reservations are subject to applicable local, state, and municipal room occupancy and lodging taxes based on the physical location of the property (including required taxes in Washington, Virginia, New Hampshire, Connecticut, and Rhode Island). Any other booking, resort, or cleaning fees will be clearly itemized at checkout.

2.3 Payment Schedule: A deposit of 50% of the total reservation cost is required at the time of booking to secure your dates. The remaining 50% balance will be automatically charged to the card on file 14 days prior to your arrival. For reservations made within 14 days of arrival, the full amount is due at the time of booking.

2.4 Credit Card Authorization & Chargeback Policy: * Explicit Authorization: By providing your credit card information and completing this booking, you explicitly authorize EG Enterprises LLC dba iUgo to charge your card for the total reservation amount, as well as any post-stay charges related to documented damages, missing items, smoking fees, unauthorized pets, or late check-out fees as outlined in these Terms.

Proof of Service: You agree that accessing the property (e.g., via provided smart lock codes or lockboxes) constitutes explicit confirmation that the agreed-upon services have been rendered.

Dispute Resolution: You agree to contact iUgo management in writing to attempt to resolve any billing discrepancies or grievances prior to contacting your credit card company. You explicitly waive the right to dispute charges for reservations canceled outside the permitted cancellation window, Force Majeure events, or documented damage penalties.

Fraudulent Chargebacks: Initiating an unwarranted, fraudulent, or "friendly fraud" chargeback is a material breach of this contract. If you initiate a chargeback that is subsequently decided in our favor by the issuing bank, you agree to pay a $150.00 administrative dispute fee to cover our time and resources, in addition to any legal fees, collection costs, and the original disputed amount. We reserve the right to report fraudulent chargebacks to guest screening networks and local authorities.

3. Identity Verification and Fraud Prevention

3.1 Guest Screening: To ensure the safety of our properties and communities, iUgo utilizes third-party services, including SafelyStay, Inc., for fraud prevention and identity verification.

3.2 Compliance: By booking, you agree to provide accurate information and cooperate with our identity verification processes. Failure to complete screening requirements prior to check-in may result in the cancellation of your reservation without a refund.

4. Property Rules & Guest Expectations

As a manager of premium vacation rentals, we strictly enforce rules to protect our properties and the surrounding neighborhoods. By staying with us, you agree to adhere to the following general house rules, as well as any property-specific rules provided upon booking:

4.1 Check-In / Check-Out: Standard check-in time is 4:00 PM and check-out time is 11:00 AM (local time of the property). Early check-ins and late check-outs must be requested in advance, are strictly subject to availability, and may incur an additional fee. Guests who remain on the property beyond the designated check-out time without prior written approval will be subject to a holdover fee equal to twice the nightly rate for each day they overstay, plus any damages incurred by the company due to the delay.

4.2 Damages and Incidentals: Guests must report any pre-existing damage or issues to management within 2 hours of check-in. Guests are responsible for any new damage to the property, furnishings, or missing items caused during their stay by themselves or their visitors. iUgo reserves the right to charge the credit card on file via Stripe for the repair or replacement costs of any damages discovered after check-out. Whenever possible, we will provide an itemized list and photographic evidence of the damages to the guest prior to or concurrent with processing the charge.

4.3 Smoking Policy: All iUgo properties are strictly smoke-free indoors. Smoking of any kind (including cigarettes, cigars, marijuana, and vaping) indoors will result in a minimum $500 deep-cleaning fee charged to your card on file.

4.4 Pet Policy: Pet policies vary by individual property. You may only bring a pet if you have booked a designated pet-friendly property and paid the applicable pet fee. Bringing an unauthorized pet into any property will result in a minimum $250 penalty and immediate cancellation of your stay without a refund. Documented, legally recognized service animals are exempt as per federal law (please notify us in advance).

4.5 Parking: Parking availability and rules vary by property. Guests must adhere to the specific parking instructions provided for their rental. Parking outside of designated areas or reservation times may result in towing at the vehicle owner's expense.

4.6 Good Neighbor Policy & Quiet Hours: To respect our neighbors and local communities, strictly enforced quiet hours are generally from 10:00 PM to 8:00 AM local time across all properties. At all times, guests must avoid disruptive behavior, loud music outdoors, and must adhere to all local property instructions regarding trash disposal and recycling.

4.7 No Parties, Events, or Unregistered Guests: Events, parties, and large gatherings are strictly prohibited. Maximum occupancy limits are strictly enforced. Only guests registered on the reservation are permitted overnight on the property. Violation of this rule will result in the immediate termination of your reservation and removal from the property without refund. By booking, you acknowledge that your stay constitutes a short-term transient license to occupy the property, and does not create a tenancy or landlord-tenant relationship under WA, VA, NH, CT, or RI law.

4.8 Right of Entry: iUgo management, staff, or designated contractors reserve the right to enter the property at any reasonable time for maintenance, inspections, emergencies, or to verify compliance with these Terms. We will make every reasonable effort to provide advance notice and minimize disruption to your stay.

5. Cancellations and Refunds

5.1 General Cancellation Policy: Unless a specific property listing states otherwise, guests who cancel their reservation 14 days or more prior to their scheduled arrival date will receive a full 100% refund of their deposit. Cancellations made less than 14 days prior to arrival are entirely non-refundable.

5.2 Unforeseen Circumstances: We highly recommend guests purchase independent travel insurance, specifically 'Cancel For Any Reason' (CFAR) policies, to protect their investment. Please note that iUgo does not sell travel insurance, nor do we have any affiliations, partnerships, or financial relationships with any third-party insurance providers. Guests must independently source their own coverage. iUgo is not responsible for issuing refunds or credits due to weather events, personal emergencies, illnesses, or travel delays that fall outside of our standard cancellation window. Additionally, iUgo cannot be held liable for reservation cancellations, alterations, or disruptions caused by Force Majeure events (including but not limited to severe weather, natural disasters, utility outages, government mandates, or pandemics). In such rare instances where iUgo must cancel, liability is strictly limited to refunding the amounts paid.

6. Website Use and Intellectual Property

6.1 License: Unless otherwise stated, EG Enterprises LLC and/or its licensors own the intellectual property rights for all material on the iUgo website. You may access this for your own personal, non-commercial use, subject to restrictions set in these terms.

6.2 Restrictions: You must not republish, sell, rent, sub-license, reproduce, duplicate, or redistribute content, images, or branding from the iUgo website without prior written consent.

6.3 Website Availability: We do not guarantee that the website or its reservation engine will be available at all times without interruption, nor do we warrant that the information on the website is universally free of errors.

7. Limitation of Liability

To the maximum extent permitted by applicable law, EG Enterprises LLC dba iUgo and its property owners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your stay or use of our website.

7.1 Personal Property & Lost Items: We are not responsible for loss, damage, or theft of personal items, valuables, or vehicles left on the property or in parking areas. If items are left behind after check-out, we will make a reasonable effort to locate them. If found, guests are responsible for paying all shipping and handling costs to have the items returned. Unclaimed items will be donated or discarded after 30 days.

7.2 Personal Injury & Amenities Waiver: Guests agree to use the properties and any provided amenities (including but not limited to pools, hot tubs, fire pits, bicycles, or watercraft) entirely at their own risk. Any use of these amenities by minors must be strictly supervised by an adult at all times. We are not liable for any personal injury occurring on the premises, except in cases of gross negligence on the part of the company.

7.3 Indemnification: You agree to indemnify, defend, and hold harmless EG Enterprises LLC dba iUgo, its officers, employees, and property owners from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal and accounting fees) arising out of or in any way connected with your access to or use of the properties, or your violation of these Terms.

8. Governing Law and Jurisdiction

Due to the multi-state nature of our operations, jurisdiction is handled as follows:

8.1 Corporate & Website Disputes: For any disputes related to the use of the iUgo website, corporate policies, or general business practices, these Terms shall be governed by and construed in accordance with the laws of the State of Connecticut, with exclusive jurisdiction in New London County, Connecticut.

8.2 Property & Stay Disputes: For any matters, damages, accidents, evictions, or disputes arising directly from your physical occupancy of a specific vacation rental, the governing law and jurisdiction shall default to the state and county where the physical property is located (Washington, Virginia, New Hampshire, Connecticut, or Rhode Island).

8.3 Arbitration: You agree that any dispute arising from or relating to these Terms will be resolved through binding arbitration. You explicitly waive your right to a trial by jury and your right to participate in a class action lawsuit.
